ConsultCloud Refund and Chargeback Policy

This policy explains how billing, refunds, cancellations and chargebacks are handled for ConsultCloud subscriptions provided by Digital Works Nottingham Ltd, trading as ConsultCloud ("ConsultCloud", "we", "us").
1. Merchant of Record
Our payments, billing, invoicing, tax collection and remittance, fraud prevention and chargeback handling are provided by Paddle.com Market Ltd ("Paddle"). Paddle acts as the reseller and Merchant of Record (MoR) for all ConsultCloud subscriptions. This means that when you purchase a subscription, your contract for payment is with Paddle and Paddle is the party that appears on your card statement (typically as "Paddle.net* ConsultCloud" or similar). The underlying software service is provided by Digital Works Nottingham Ltd.
2. Free trial
ConsultCloud offers a free trial that ends after 7 days or after three complete project workflows (Brief, Proposal, Statement of Work, Resource Match and Export), whichever comes first. No payment card is required to start the trial, and no charge is made unless you choose to subscribe to a paid plan.
3. Subscriptions and renewals
- Monthly subscriptions renew automatically every month until cancelled.
- Annual subscriptions renew automatically every 12 months until cancelled.
- For annual plans we send a renewal reminder by email at least 30 days before the renewal date.
- You can cancel at any time from within the application. Cancellation takes effect at the end of the current billing period and you retain access until then.
4. Refunds and Cancellations
ConsultCloud is provided for business and professional use. By purchasing a subscription, you confirm that you are entering into the agreement in the course of a business, trade or profession and not as a consumer.
Subscription charges: Subscription fees are non-refundable once the relevant subscription period has begun, except where required by law or expressly stated in these terms.
Renewals: Monthly and annual subscriptions will renew in accordance with the subscription terms applicable to your account. Renewal charges are non-refundable once the new subscription period has begun.
Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current paid subscription period and you will continue to have access to the service until that date. No refund or credit will normally be provided for any unused portion of the subscription period.
Service failure: Where ConsultCloud has been materially unavailable or has materially failed to provide the service in accordance with these terms, we may provide an appropriate service credit, partial refund or full refund, depending on the circumstances and any rights or remedies available under these terms or applicable law.
Discretionary refunds: We may issue a full or partial refund at our discretion in exceptional circumstances. Any discretionary refund does not create an entitlement to a refund in similar circumstances in the future.
Nothing in this section excludes or limits any right or remedy that cannot lawfully be excluded or limited.
5. How to request a refund
To request a refund or query a charge, and include the email address used for the subscription, the date of the charge and a brief explanation. We acknowledge requests within two business days and aim to make a decision within five business days. Approved refunds are processed by Paddle to the original payment method, typically within 5 to 10 business days depending on your bank or card issuer.
6. Chargebacks and disputes
If you believe a charge is incorrect, please contact us first so we can resolve it quickly. Raising a chargeback with your bank before contacting us tends to delay resolution and adds cost for both sides. Where a chargeback is opened, we cooperate with Paddle on the dispute process and may share evidence of subscription activity to help reach an outcome. Fraudulent or abusive chargebacks may result in suspension or termination of the account and recovery of fees and costs through Paddle.
7. Failed payments
If a renewal payment fails, Paddle will retry the charge over a short dunning period and notify you by email. If payment cannot be completed, access to paid features may be suspended until payment is brought up to date. Repeated failed payments may result in cancellation of the subscription.
8. Taxes
Prices are shown exclusive of VAT and other applicable sales taxes unless stated otherwise. As Merchant of Record, Paddle calculates, collects and remits VAT, GST and equivalent sales taxes on our behalf based on your billing location. Tax-compliant invoices are issued by Paddle and are available from your billing receipts.
9. Cancellation and effect on data
On cancellation, your account remains active until the end of the paid period. After that, paid features are disabled. Customer project data is retained and deleted in line with our Privacy Policy.
